Terms of Service for Pitlane

Please read these Terms of Service ("Terms") carefully before using Pitlane (the "App"), operated by Anatolii Osokin ("we," "our," or "us").
By downloading, installing, or using Pitlane, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using Pitlane, you confirm that:
- You are at least 13 years of age (or at least 16 if you are located in the European Economic Area);
- You have the legal capacity to enter into a binding agreement; and
- You agree to comply with these Terms and all applicable local, national, and international laws.
If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of the App
Pitlane is a vehicle maintenance tracking application that allows users to:
- Store and manage information about their vehicles
- Log service records, parts, and associated costs
- Track maintenance intervals and schedules
- Extract service data from receipt photographs using AI-assisted OCR
- View service stations associated with past maintenance visits
The App is provided on a freemium basis. Certain features may require a paid subscription in the future. Current availability of free and paid features is displayed within the App.
3. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use Pitlane on Apple-branded devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.
This license does not permit you to:
- Copy, modify, adapt, or create derivative works of the App or its content
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
- Rent, lease, lend, sell, sublicense, or otherwise transfer rights to the App
- Remove or alter any copyright, trademark, or other proprietary notices
- Use the App for any unlawful or unauthorised purpose
- Use the App to develop a competing product or service
- Attempt to gain unauthorised access to any systems or networks connected to the App
4. User Accounts
4.1 Registration
To access the full functionality of Pitlane, you must create an account using your email address. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access or suspected breach at osokingauss@gmail.com
We are not liable for any loss or damage arising from your failure to maintain account security.
4.3 One Account Per User
Each user may maintain one active account. Creating multiple accounts to circumvent restrictions or abuse the service is prohibited.
4.4 Account Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Conduct we determine is harmful to other users, to us, or to third parties
- Suspected fraudulent or illegal activity
You may delete your account at any time by contacting us at osokingauss@gmail.com.
5. User Content
5.1 Ownership
You retain full ownership of all vehicle data, service records, photos, and other content you create or upload within Pitlane ("User Content").
5.2 License to Us
By using the App, you grant us a limited, worldwide, royalty-free license to store, process, and display your User Content solely as necessary to provide the service to you. We do not use your User Content for any other purpose.
5.3 Acceptable Use
You agree not to submit User Content that:
- Is false, misleading, or fraudulent
- Infringes the intellectual property rights of any third party
- Contains malware, harmful code, or links to malicious content
- Violates any applicable law or regulation
5.4 Receipt Images
When you use the photo capture feature, a photograph of a service receipt is transmitted to a third-party AI service (Anthropic) for text extraction. You are responsible for ensuring you have the right to submit any document you photograph. Do not photograph documents containing third-party confidential information without appropriate authorisation.
6. Guest Mode
Pitlane offers a guest mode with limited functionality. In guest mode:
- No account is created and no data is transmitted to our servers
- All data is stored locally on your device and discarded when the app is closed
- Creating an account is required to persist data
7. Subscriptions and Purchases
7.1 Current Status
As of the Effective Date, Pitlane is provided free of charge. A premium subscription tier is planned for future release. This section governs any future paid features.
7.2 Pricing and Billing
- All prices will be displayed in your local currency via the Apple App Store.
- Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your Apple ID account will be charged at the time of purchase and for each renewal.
7.3 Cancellation
You may cancel a subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
7.4 Refunds
All purchases are processed by Apple. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We do not process refunds directly.
7.5 Free Trials
If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand. One free trial per Apple ID.
8. Third-Party Services
The App integrates with third-party services including Supabase (cloud database and authentication) and Anthropic (AI-based receipt processing). Your use of these services through the App is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.
9. Intellectual Property
Pitlane, including its name, logo, design, code, features, and all content we create, is owned by Anatolii Osokin and protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
All trademarks of third parties (including vehicle manufacturers and service companies) remain the property of their respective owners.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure at all times
- Defects or errors will be corrected
- The App or its servers are free of viruses or other harmful components
- Results obtained from using the App (including AI-extracted data) will be accurate or reliable
Maintenance data and AI-extracted information should always be verified against your actual vehicle records and service documentation. Pitlane is a convenience tool and does not replace professional automotive advice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANATOLII OSOKIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF DATA OR SERVICE RECORDS
- LOSS OF PROFITS OR REVENUE
- VEHICLE DAMAGE ARISING FROM RELIANCE ON APP-PROVIDED MAINTENANCE INFORMATION
- INTERRUPTION OF BUSINESS
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF PITLANE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow exclusion of certain warranties or limitations on liability. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Anatolii Osokin from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your User Content
- Your violation of any applicable law or third-party right
- Your use of the App in a manner not authorised by these Terms
13. Termination
13.1 By You
You may stop using the App at any time by deleting it from your device and, if applicable, requesting account deletion by emailing osokingauss@gmail.com.
13.2 By Us
We may suspend or terminate your access to the App at any time, for any reason, with or without notice. We will endeavour to provide advance notice where reasonable.
13.3 Effect of Termination
Upon termination:
- Your license to use the App is revoked immediately.
- We may delete your account data after a reasonable notice period (subject to our data retention obligations).
- Provisions that by their nature survive termination will remain in effect, including Sections 5 (User Content — license only terminates upon data deletion), 9 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law).
14. Changes to Terms
We may update these Terms at any time. For material changes, we will:
- Update the "Last Updated" date at the top of this document
- Display an in-app notice or send an email notification
- Post updated Terms at pitlaneapp.uk/terms
Continued use of the App after updated Terms are posted constitutes your acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the App.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms or your use of the App shall be resolved as follows:
- Informal resolution: Contact us at osokingauss@gmail.com. We will endeavour to resolve disputes informally within 30 days.
- Formal proceedings: If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Indonesia.
Notwithstanding the above, users in the European Union retain the right to bring claims before their local courts and applicable consumer protection authorities.
16. Apple-Specific Terms
The following terms apply to your use of the App obtained through the Apple App Store:
- These Terms are between you and Anatolii Osokin only, not Apple Inc. Apple has no obligation to provide maintenance or support for the App.
- Apple is not responsible for addressing any claims related to the App, including product liability, consumer protection, or intellectual property infringement.
- In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, the Apple terms shall govern with respect to the App Store relationship.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. General
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Anatolii Osokin regarding your use of the App.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
No waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign or transfer these Terms or any rights under them without our written consent. We may assign these Terms freely.
